§ 1 Definitions
- BE HAPPY MUSEUM - BHM7 sp. z o.o., ul. Złota 7/28, 00-019 Warsaw, KRS: 0001091057, NIP: 5252994534 (hereinafter: BHM7)

- Rules and Regulations - these Rules and Regulations set out the principles relating to the online purchase of admission tickets entitling visitors to the attractions offered by BHM7 at all its locations via the Internet, as well as the terms and conditions for the use of the ticket purchasing system provided by BHM
- Buyer - a person purchasing a ticket through the BHM7 website located at: https://bilety.behappymuseum.com/bilety-szczecin, https://bilety.behappymuseum.com/bilety-krakow oraz https://biletybehappymuseum.com/bilety-zakopane;
- User - the Buyer or any other person using the services offered by BHM7 through the website
- Ticket - an admission ticket entitling to visit an exhibition at the time and place specified during the purchase process;
- Payment Operator - PayU SA with its registered office in Poznań, 60-166 Poznań, ul. Grunwaldzka 182, a national payment institution, supervised by the Polish Financial Supervision Authority, entered in the Register of Payment Services under number IP1/2012, entered in the Register of Entrepreneurs kept by the District Court in Poznań - Nowe Miasto and Wilda in Poznań, 8th Economic Department of the National Court Register under number KRS 0000274399, with a share capital of 4. 944,000 PLN, fully paid up, holding tax identification number NIP: 779-23-08-495, REGON: 300523444. The use of the payment services of the Payment Operator takes place after the redirection to the payu.pl website, under the conditions specified by the Payment Operator in the regulations made available there. Before using the payment services, the Buyer is obliged to read the regulations of the Payment Operator and accept its terms and conditions. - Services - The services provided electronically by the Website Owner consist of:
- communication between BHM7 and the User;
- Providing information to the User;
- enabling the purchase of tickets via the Website and providing services related to ticket purchase (e.g. complaints, refunds);
§ 2 General provisions
- These Terms and Conditions set out the rules concerning the sale of Tickets for attractions offered by BHM7 via the Internet;
- The purchase of a Ticket is conditional on the prior acceptance of these Rules and Regulations, which at the same time obliges the Buyer to abide by them;
- Acceptance of the Regulations also obliges the Buyer to comply with other provisions of common law;
- Making a purchase of Tickets via the Internet obliges the Buyer to use the provided system in a manner compliant with the law and rules of social co-existence. In particular, it is forbidden to use the service for the purpose of sending illegal and unsolicited content.
- In order to ensure correct and undisturbed use of the Website and the services provided through it, the device used by the User should meet the following minimum technical requirements:
- have a connection to the Internet ensuring data transmission,
- have an Internet browser, i.e. software used to view content available on the Internet. Disabling the acceptance of Cookies and Java Scripts may disrupt the proper operation of the Shop's website,
- have an active electronic mail (e-mail) account,
- In order to read e-mail correspondence and its attachments, it is necessary to have: in the case of e-mail correspondence - an active e-mail account (e-mail), in the case of attachments, including in particular text files - computer software supporting files of a given type, in particular .pdf, .doc., .docx, .txt, .jpg,
- The scope of services provided by BHM7 does not include the provision of equipment or software necessary for the use of the Services available on the Website,
- The use of the services provided electronically on the Website, due to the transmission of data via the public Internet, involves risks in the form of the possibility of interference by unauthorised third parties in the data sent between the Website Owner and the User,
- The User has the right to use the Services in accordance with the principles set out in these Regulations. By using the Service, the User is deemed to be acquainted with these Terms and Conditions. The Terms of Use may be recorded by the User by saving them to a disk of the device or by printing them out,
- he User is obliged to refrain from copying, modifying, distributing, transmitting or otherwise using any content and databases made available to him by the Owner as part of the Services provided,
- The commencement of the use of the services provided by the Owner of the Website takes place from the moment the User starts using a given Service,
- In order to terminate the use of the Service, thereby terminating the respective Service, the User leaves the website under which the Service is provided. No additional declaration is necessary or required.
§ 3 Communication services
- The User is given the opportunity to contact BHM7 directly through this service,
- The user shall be given the option of using a contact form through which he/she may contact BHM7 to make enquiries about the products offered,
§ 4 Information services
- Information services consist of enabling the User to access information provided on the website via a displayed web page, including in particular: information about the owner of the website, including contact details, information about available products, including those available in the online shop, and about stationary services provided by the Owner of the website.
§ 5 Purchase of a Ticket
- Purchasing a ticket online on the BHM7 website is possible after accepting the Terms and Conditions, without registering.
- In order to make a purchase, the Buyer is required to select the location, date and time of entry, and then choose the number and type of tickets.
- In order to make a purchase, the Buyer's name and email address must be provided and payment must be made through the Payment Operator.
- Once payment has been made correctly, BHM7 will deliver the purchased Ticket via the email provided when placing the order.
- The Ticket is valid both electronically and when printed;
- The Buyer is required to present a valid Ticket to a BHM7 employee in order to use the attraction.
- Only individual and so-called family tickets can be purchased via the Internet. In order to purchase a group ticket, BHM7 must be contacted electronically, e.g. using the form available on the website;
- An up-to-date schedule listing the available visiting days and times for BHM7 is available on the website. The schedule is continuously updated.
- At the time of purchase, the Buyer may choose whether or not a VAT invoice is to be issued for the purchase made. In order to receive a VAT invoice, it is necessary to provide the necessary details for issuing the invoice before paying for the transaction, according to the form on the website;
- The invoice will be sent by e-mail.
- Payment must be made within 12h of selecting the appointment, without interrupting the transaction. After this time, the booked tickets will return to the pool of general public tickets.
- An email containing your payment confirmation and purchased tickets should arrive within 5 minutes. If you do not receive a message, please check your SPAM box and if there is no message in the folder of unwanted messages, please contact an employee of the branch where the purchase was made by phone or e-mail:

§ 6 Admission to the Exhibition
- The purchased e-ticket entitles the visitor to enter the Exhibition grounds on the day of the visit, no earlier than 15 minutes before the time for which the visit is booked, but no later than 15 minutes after the selected time of the visit. If the tickets are not redeemed within the indicated time slot, BHM7 will not refund them;
- The possibility of admission, in case of lateness of more than 15 minutes, depends on the number of visitors;
- A change of admission time is only possible in special cases at the discretion of a BHM7 employee and is dependent on the number of visitors and the availability of dates;
§ 7 Complaints
- Any complaints regarding online purchases must be made within 7 days of purchase.
- Complaints shall be submitted by email to info@behappymuseum.com or in writing to BHM7's registered office address or at the Branch cash desk.
- The complaint will be processed within 14 days of receipt of the complaint. The decision on the complaint shall be communicated in writing or by e-mail - depending on the method of complaint or at the Buyer's choice;
- The complaint should include:
- the number of the order to which the complaint relates;
- the reason for the complaint along with a description of the situation to which the complaint relates and the expected manner of resolving the complaint;
- name and surname;
- e-mail address or address of residence;
- the complainant may also provide a telephone number to expedite contact.
- If the complaint is resolved in the Buyer's favour, the Buyer is entitled to another Ticket or a refund. Refunds are made by bank transfer to the account from which the Ticket was purchased.
- The Museum is not responsible for complaints submitted incorrectly, especially for the provision of incorrect or untrue data by the Buyer.
- The consideration of a complaint does not exclude the Buyer's right to pursue claims on general principles.
§ 8. Return of a Ticket for reasons attributable to BHM7
- In the event that a visit to BHM7 for which a Buyer has had a ticket purchased and paid for does not take place or will not take place for reasons attributable to BHM7 (e.g. breakdown) or the occurrence of circumstances of a force majeure nature, BHM7 shall immediately notify the Buyers of this fact via its website or, if possible, by other means.
- In the case described in paragraph 1, the Buyers have the right at their discretion, free of charge, to change the booking date or to request a refund of the Ticket price.
- Ticket refunds will be made via email via the PayU platform in the same manner as the transaction was made
- In the case of a ticket refund via e-mail, the refund of the Ticket price shall be made to the account from which the payment was made, no later than within 7 days.
- Once the notification is recognised, the refund of the paid amount for the Tickets shall be made in the form of a transfer from the PayU platform.
§ 9. Withdrawal from the contract and out-of-court dispute resolution methods
- The Buyer shall not have the right to withdraw from a contract concluded remotely, as referred to in the Consumer Rights Act of 30 May 2014 (pursuant to Article 38(12)) of the aforementioned Act, due to the fact that it concerns the provision of services related to leisure, entertainment, sports or cultural events on a specific date or period of service.
- A buyer who is a consumer has, inter alia, the following possibilities to make use of out-of-court ways of dealing with complaints and claims:
- applying to the permanent amicable consumer court operating at the Trade Inspection with a request to resolve a dispute arising from the concluded Sales Agreement,
- applying to the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings for the amicable settlement of a dispute between a Consumer and a Service Provider.
- A Buyer who is a consumer may obtain free assistance in resolving a dispute by using the free assistance of a district (city) consumer ombudsman or a social organisation whose statutory tasks include consumer protection (e.g. Federation of Consumers, Association of Polish Consumers).

- At: http://ec.europa.eu/consumers/odr/ a platform for online dispute resolution between consumers and traders at EU level (ODR platform) is available. The ODR platform is an interactive and multilingual website with a one-stop shop for consumers and traders seeking out-of-court resolution of a dispute concerning contractual obligations arising from an online sales or service contract.
§ 10 Processing of personal data
- BHM7, as the controller of personal data, processes the Buyer's personal data only for purposes related to the purchase of the ticket, the recognition of complaints, the response to an enquiry made by the Buyer and obligations arising from generally applicable law including accounting.
